Complainant filed a petition praying for restraining the O.P. Nos. 1and 2 from taking any kind of coercive steps against the complainant in connection with his purchased motor cycle inter-alia in prohibitory form. This petition is registered as M.A. No. 90/2020. The instant petition is moved by the Ld. Advocate appearing on behalf of the complainant. Perused the complaint, the prayer for interim petition, supporting affidavit as well as the submitted documents. On perusal of the aforesaid materials it is appeared that the prima-facie case is made out. But we found no irreparable loss on part of the complainant. Rather if the instant petition in prohibitory form be allowed in that event the balance of inconvenience will create in future in trial of this summary procedure case which ought to be concluded within three months since there are several paraphernalia when prohibitory order of the court be violated and that surely be caused delay. Hence the instant petition is considered and rejected.
