The brief facts of the present complaint are that on 25/07/2010 the complainant enrolled himself with the Respondent No.I for the MBA (Financial Engineering) 2 Years Program comprising of four semesters with the Respondent No.II vide Registration/ Roll No.1021DMFE0006. He paid Rs.11,700/- for the Semester and it was assured that if he was unsatisfied with the program the fee would be refunded back to him. The Respondent No.II is working in association with Respondent No.I. The complainant deposited the entire fee for the rest of the semesters as & when demanded by the Respondents. In the IVth Semester Examination there were six subjects with Code Nos.MB19, MB20, MB21, MB22, MB23 and MB24. It is alleged that the result of IVth Semester Examination held in June/July, 2012 was declared on 15/03/2013 wherein he was declared “Pass” with VI Rank but its Marks-Sheet was not provided to the complainant till October, 2014. Only after lodging of repeated reminders through e-mails, telephones and personal visits the respondents sent a Statement of Marks for the IVth Semester Examination having Sr.No.M13 122792 dated 24/10/2013 for MBA (Dual Specialization) instead of MBA (Financial Engineering) wherein only three subjects having Subject Code Nos. as MB19, MB20 and MB24 were shown but the rest of the three subjects with Code Nos.MB21, MB22 and MB23 were not reflected therein. Repeated complaints to the respondents to rectify their mistake were of no consequence. The complainant has prayed for directions to the respondents to issue complete Statement of Marks/ Mark-sheet for the IVth Semester Program of MBA (Financial Engineering) alongwith the University Degree for it, Rs.51,000/- as compensation for harassment and Rs.21,000/- as litigation cost.
Notices were issued to the respondents but only Respondent No.I put up appearance. In compliance to the direction of this Forum it placed on record the original corrected Marks-Sheet of the complainant for MBA (Financial Engineering) IVth Semester Examination with SL.No.M14 1315610 dated 27/05/2015. With this the main issue under this complaint was disposed of vide Order dated 01/06/2015. Reverting back to the Prayer Clause of the present complaint, it is observed that the grievance left to be redressed is with regard to the issuance of the University Degree for the said Program and the compensation for the harassment meted out to him at the hands of the respondent and the cost of this litigation.
Heard and perused the record.
It is not in dispute that the complainant had cleared the MBA (Financial Engineering) IVth Semester Examination held in June/July, 2012 with VI Rank on 15/03/2013 but the respondents had earlier issued a wrong marks-sheet and later on after the filing of the present complaint and with the intervention of this Forum the complainant got his Original Marks-Sheet of MBA (Financial Engineering) IVth Semester Examination to which he was entitled to after the declaration of the result. Inordinate and unexplained delay has caused harassment to the complainant for which he needs to be compensated.
Taking all the above facts and circumstances into consideration, we arrive at a conclusion that the respondents had been deficient in providing services to the complainant. We direct the respondents to issue the degree to the complainant within 45 days from the date of this order, if not issued till date and handover the same to the complainant. We, further, direct the respondents to pay to the complainant Rs.5,000/-, either jointly or severally as compensation for harassment and litigation cost within 45 days from the date of this order failing which the complainant shall be entitled to pay interest @ 9% p.a. from the date of this order till the order is finally complied with in entirety.
