By the impugned order, State Commission has awarded a sum of Rs.50,000/- for dishonor of two cheques; one for Rs.1,25,000/- and the other for Rs.5,000/-.  Counsel for the parties are agreed that in view of the pendency of the proceedings before the Debt Recovery

Tribunal the finding recorded by the State Commission cannot be sustained and the same be set aside.

          In view of the statement made by the counsel for the parties, findings recorded by the State Commission are set aside.  Appeal is allowed and the complaint is ordered to be dismissed. 

          However, as a matter of goodwill gesture, counsel for the appellant states that the sum of Rs.25,000/- deposited by the appellant at the time of admission of the appeal be paid to the respondent.  In view of the statement made by the counsel for the appellant office is directed to release the sum of Rs.25,000/- deposited by the appellant in favour of the respondent along with accrued interest thereon.
