Heard learned counsel for the petitioner and respondent in person. Learned State Commission vide impugned order 29.11.2011 dismissed the appeal of the petitioner on account of his absence. Perusal of order reveals that after dismissal of appeal in default, on the same day the petitioner appeared before the State Commission but as the State Commission had no power to restore the appeal, the appeal was not restored. In the interest of justice, we deem it proper to allow the petition and restore the appeal. Consequently, the petition filed by the petitioner is allowed and impugned order dated 29.11.2011 passed by the State Commission in F.A. No.A/06/911 Maharashtra State Seeds Corporation Ltd. & Anr. Vs. Vilas Laxmikant Pande is set aside and the appeal is restored at its original number. Learned State Commission is directed to decide the appeal on merits after giving an opportunity of being heard to both the parties. Parties are directed to appear before the State Commission on 28.01.2013.
