JUSTICE SRI.K.R.UDAYABHANU              : PRESIDENT

The appellant is the opposite party in CC.145/08 in the file of CDRF Alappuzha.   The appellant is under orders to give a new vehicle to the complainant together  with compensation of Rs.25000/- and a cost of Rs.2000/-.  The matter relates to the defects of the vehicle sold  to the complainant. 

2.The opposite parties/appellants were ex parte in the proceedings before the Forum and they have sought for opportunity to contest the matter for the reasons mentioned for the omission to file the version.  The order of the Forum is set aside on condition that the appellant pay a sum of Rs.5000/- towards cost to the complainant.  The amount of cost is to be paid to the complainant directly or deposited before the Forum which can be withdrawn by the complainant.  On payment of cost the Forum will permit the opposite parties to file version and contest the case.

3. The case stands posted before the Forum on 30.11.2009.

          Office is directed to forward the copy of this order to the Forum urgently.
