ORDER

JUSTICE SRI.K.R.UDAYABHANU    : PRESIDENT

Revision petitioner is the opposite party in CC.86/2008 in the file of CDRF, Palakkad.  The order sought to be revised is in IA.179/2009.

          We find that the Forum has issued a very cryptic order and without mentioning the reasons properly.  We find that the matter is with respect to the applications filed to set aside the commission report, application to appoint fresh commissioner and application to cross examine the commissioner.  We have seen the report of the Commissioner  which is also a cryptic one.  No split up details of the cost of repair work is provided.  He has estimated the cost as Rs.1 lakh.  It is a one page report without containing the details.  The Forum has dismissed the application to set aside the commission report in a one line order.  We find that the Forum ought to have dispose of the applications by specifying the reasons and not in such a manner.  A considered order contemplates proper discussion of the respective contentions and the findings supported by reasons.

          In the circumstances as agreed by the counsel for both sides the Forum is directed to remit the commission report with liberty to both sides to file work memos which the commissioner should examine and report.            The revision petition is allowed as above.

          The case stands posted before the Forum on 25.3.2010.

          Office is directed to forward the LCR to the forum along with the copy of this order urgently.
