Called out. Ld. counsel for the appellant Sri Brijendra Chaudhary is present. Ld. counsel for the respondent Sri Saksham Mishra is present.

Parties have entered into a compromise and today the appellant has brought a cheque of Rs.3,82,258.59 and handed over to the counsel for the respondent.

A memorandum of settlement has been filed. Keep on record.

Now there is no dispute between the parties.

 Appeal is decided in terms of memorandum of settlement.
