FINAL ORDER
This case relates to an application of the complainant praying for new gas connection.
The complainant, Sudhir Paloi, of Vill. and P.O-Gopalnagar, P.S. – Kolaghat, District – Purba Medinipur, Pin 721130 applied on 15/11/2013 for new LPG connection before the OP, Vidyasagar Indane Services, situated at Vill-Kola (Vivekananda more) P.O+P.S-Kolaghat, District -Purba Medinipur being a distributor of LPG connection of IOC. The complainant fulfilled all material obligations in obtaining the connection but the complainant alleges that the Opposite Party denied him connection as he refused to buy items other than regulator, pipe and cylinder. The complainant also moved before the Office of the Assistant Director, Consumer Affairs and Fair Business Practices, Purba Medinipur R.O. agitating the matter. The complainant has made allegation of unfair trade practice and service deficiency against the OP.
The Opposite Party appeared in the case in person represented by one Saheb Shaw and filed his W/V, wherein he states that as the complainant did not make the concrete slab for keeping the hot plate/oven so OP was unable to give LPG connection as per Indane.
We have gone through all the documents filed by the parties. It appears that the complainant made an application before the Office of the Assistant Director, Consumer Affairs and Fair Business Practice, Purba Medinipur R.O. on 08/07/2014 and the same was amicably settled on 24/07/2014 through mediation and direction was given that the complainant shall make a concrete platform for keeping the hot plate/oven and shall remove the mud oven and the hot plate shall not be installed near the switch board. There after one year passed. But service connection has not yet been effected to the premises or kitchen of the complainant.
Be that as it may, it appears that the application for new Indane connection of the complainant was matured on March 2014, but the OP failed and neglected to render gas connection to the complainant for reasons best known to him. The ground of premonition of security hazard is not convincing to us. The complainant has, however, alleged that the OP failed and neglected to give gas connection as he refused to buy other items except regulator, pipe and cylinder.
Considering all aspects, we think that the OP is guilty of unfair trade practice and he must render LPG connection to the premises of the complainant forthwith.
Hence, it is,
ORDERED
that the instant case being no. CC/55/2015 be and the same is allowed on contest against the OP. The OP is directed to give LPG connection alongwith regulator, pipe and cylinder minus non-fuel materials, like accessories and other articles (not wanted by the complainant) to the complainant within 7 days from the date of passing this order. OP is further directed to give an amount of Rs.10000/- as compensation for causing mental agony and harassment to the complainant within 40 days from the date of this order, i.d. the complainant will be at liberty to execute this order in accordance with the appropriate provisions of the law and in such case the OP will be liable to pay interest @ 9% on the said amount, till realization in toto. As complainant himself conducted his own case in person, we pass no order as to litigation cost.
