                         This petition has been filed on behalf of the appellant as also   the respondent no.3 separately stating that the matter has been amicable settled.

             Appellant seeks permission in view of the matter has been settled  to refund the amount of Rs. 25000/- as the amount  was deposited at time of filing of the appeal be refund back.

             In view of the petition filed for amicable settlement  by the appellant  the appeal stands dismissed as withdrawn.

             The amount of Rs. 25000/- be  refunded to the appellant as per F.D.R.
