The grievance of the complainant is that opposite parties committed inordinate delay in servicing the Kenstar Split air conditioner that he purchased from opposite party on 11-03-2010 which was having one year full warranty and extended additional warranty of 4 years to the compressor. According to him the split air conditioner was taken for repair in May 2012 but they serviced and returned the unit only in December 2012 and as a result he suffered.
2. Opposite party No.1 did not file any version. However during enquiry the representative of opposite party No.1 submitted that the delay in service is occurred due to the non-availability of the spare parts, but after replacing the compressor gas is filled free of cost which is otherwise chargeable.
3. Opposite party No.2 filed version stating that they are the dealers of air conditioner and the complaints/defaults are to be looked after by a separate authorized service franchisee.
4. Complainant filed proof affidavit and Exts A1 & A2 marked. Both sides heard. During hearing the representative of opposite party No.1 submitted that there was no willful laches on their part to service the Air Conditioner unit of the complainant and it was caused only because of the non-availability of spare parts. He further stated that the gas is filled in the air conditioner free of cost which was otherwise chargeable to the tune if Rs.1500/-.
5. In view of the above we are not inclined to award any compensation to the complainant.
Hence the complaint is dismissed with no order as to costs.
