ORDER

Heard learned counsel for the petitioners. In this matter, complainant/respondent applied for allotment of plot of 300 sq. mtrs. but the petitioner increased the size of plot by 60 sq. mtrs. and demanded money for excess area. The complainant made payment of excess area but at the time of possession only possession of 300 sq. mtrs. was given to the complainant, hence he filed complaint for refund of excess amount paid for 60 sq. mtrs. along with interest. District Forum allowed the complaint and directed the OPs-petitioners to pay 12% interest on Rs.2,43,265/- charged by the OPs/petitioners towards excess area of the plot from the date of deposit i.e. 12.05.2005 till realization. Petitioners filed appeal against the order of the District Forum, which was dismissed by the learned State Commission vide impugned order and now the petitioners have filed this revision petition against the impugned order. Learned counsel for the petitioners submitted that as per circular dated 23.01.2006 rate of interest has been reduced on delayed payment from 14% to 12% and on possession from 11% to 9% but this circular is not applicable as money was deposited in the year 2005 and at that time circular dated 17.12.2002 under which the rate of interest payable on balance amount has been reduced from 15% to 11% and on delayed payment from 18% to 14%. Meaning thereby, the complainant was entitled to receive interest @ 14% on excess amount paid by him but the District Forum allowed only 12% interest, which is in accordance with law and this order has already been upheld by the learned State Commission and does not call for any interference. Consequently, the revision petition is dismissed at admission stage with no order as to costs.
