Final Order / Judgement

Sh.Kshitij Sinha, Manager-CRM of Opposite Parties has come present in person and made a following separate statement before this Commission:-

          “Stated that I am Authorized Representative of the Opposite Party-company and today came in this Commission to hand over four cheques of the compromise amount to the complainant as per compromise effected between the complainant and Opposite Party. Today, I have received the affidavit for Refund from the complainant in this Commission and company has already received original agreement from the complainant regarding the flat in question.”

On the other hand, Smt.Kanchan Sharma complainant has made a following separate statement before this Commission:-

“Stated that the Opposite Parties have effected compromise with me and as per this compromise, they are ready to return my entire initial deposited amount of Rs.8,53,975/- in four installments as full and final settlement of my claim. Today, I have received four cheques bearing no.011827, amounting to Rs.2,50,000/- dated 31.03.2024, cheque bearing no.011828 amounting to Rs.2,00,000/- dated 30.04.2024, cheque bearing no.011829 amounting to Rs.2,50,000/- dated 31.05.2024, cheque bearing no.011830 amounting to Rs.1,53,975/- dated 30.06.2024 respectively from the Sh.Kshitij Sinha, Manager-CRM of Opposite Parties. After clearance of these cheque, I have no claim left with the Opposite Parties. I also relinquish my claim regarding my Flat No.B1-704 at 7th Floor in Project No.Pocket-B in Lok Aawas Scheme of the Opposite Parties situated at Mohali, which is the property in question in the present complaint. In future, I will not claim any ownership right and possession of the said Flat. I have no objection, if the Opposite Parties sold the said flat to 3rd Party. In lieu of this compromise, I withdraw the present complaint and the same  may kindly be dismissed as withdrawn being fully satisfied.”

In view of the statement made by the complainant, the present complaint stands dismissed as withdrawn being fully satisfied. Copies of the order be supplied to the parties free of costs. File be consigned to record room after compliance.
