1. The complainant is partly allowed.

2. OP is directed to refund Rs. 25,773/- to complainant. In case this sum is paid within 45 days of this order, no interest shall be payable since the interest so far earned on this amount can be considered to go towards maintenance expenses undertaken by OP for the period that he undertook such maintenance. Failure to pay this sum within 45 days will attract simple interest thereon @ 9% p.a. from date of this order till payment.

3. Complainant is awarded compensation of Rs. 1,00,000/- on account of harassment suffered by complainant due to failure by OP in providing promised amenities, for the undue delay in executing Sale Deed and retaining Maintenance Deposit. This amount, too shall carry no interest if paid within 45 days of this order, gailing which it will carry simple interest @ 9% p.a. fom date of this order till payment.

4. In the facts of the matter, Complainant is awarded costs of Rs.5,000/-.

5. OP shall comply with the above directions within 45 days of date of this order.
