This appeal is directed against the orders dated 26-06-2013 in C.C.No.13/2013 on the file of District Forum-II, Krishna at Vijayawada whereby the complaint filed by the complainant/respondent against the appellant herein under Section 12 of the Consumer Protection Act, 1986 was allowed and the appellants were directed to pay the assured sum of Rs.3,00,000/- with interest thereon at 12% p.a. from 17-9-2012 till payment together with costs of Rs.4,000/-.
Today when this matter is taken up for hearing, Mr.Nageswara Babu, appearing for the respondent/complainant submitted that the matter was settled between the parties and accordingly the amount has been deposited before the District Forum and he was permitted to withdraw the said amount. In fact the complainant is present and he admitted that he has withdrawn the amount. In these circumstances nothing survives in this appeal and accordingly this appeal is dismissed. No costs.
While preferring the appeal, the appellant has deposited an amount of Rs.25,000/- towards statutory deposit. The said amount is directed to be transferred to enable the concerned parties to take steps to recover the said amount.
