The appellant is the complainant in CC.66/08 in the file of CDRF, Kasaragod.
2. The complainant filed by the complaint seeking compensation for refusal to grant him the entire amount of loan applied for ie. Rs.30,000/- and also for not issuing the cheque book on behalf of his wife Leela stands dismissed. Although, he applied for a loan of Rs.30,000/-, the opposite parties/Farmers Co-operative Bank granted only a sum of Rs.5,000/-.
          3. It is the case of the opposite parties that he availed a loan of Rs.3600/- for digging a well and Rs.5956.70 for purchasing pumpset in the year 1993.   He repaid only Rs.240/- and Rs.376.70 respectively towards the above loans. After the arbitration proceedings, the decree was executed by the sale officer with police escort.
          4. The evidence adduced consisted of the testimony of PW1, Exts.A1 to A3 and B1 to B8.
          5. At the time of hearing, the appellant who appeared in person  submitted that subsequently the cheque book in the name of his wife was issued to him. Hence he has no complaint on the above ground.
          6. We find that there is no illegality in the order of the Forum, as the opposite parties cannot be compelled  to provide loans for a large amount as the complainant had failed to repay the earlier loans.   There is no patent illegality in appreciation of evidence by the Forum. We find that there is no scope for admitting the appeal.
          7. In the result, the appeal is dismissed in limine.
          Office will forward the copy of this order to the Forum urgently.
