The complainant’s case is as follows: The respondent is the proprietor of Veeramani Tourist Home. The respondent made an advertisement offer that the said respondent is ready to give 3 days free stay in a double room in Veeramani Tourist Home every year and also to give one sari and dhoti worth Rs.400/- free of cost if a person pays Rs.10,000/- to the respondent, which is refundable. Further in order to get the rooms etc. to identify the persons a pass is to be issued by the respondent every year. Believing the words of the respondent the complainant gave Rs.10,000/- to the respondent and a receipt dtd. 1.6.07 bearing No.0070 was issued by the respondent. But after receiving the money the respondent did not issue the dresses and passes every year as offered. The complainant did not receive the pass of 2008 and dresses during 2008 and 2009. Thereafter on 7.10.09 the complainant had booked a double room in the respondent tourist home for 3 days. But the respondent denied the room and he was forced to approach the Guruvayur Police Station to secure the room. So the acts of the respondent amounts to unfair trade practice and deficiency in service. The complainant had suffered mental agony due to the above said acts of the respondent. Hence the complaint.

          5. There is no evidence to the contrary.

          6. In the result the complaint is allowed and the respondent is directed to issue the pass of 2008 and to issue the pass every year for the 3 days stay in the respondent tourist home and further to pay Rs.800/- as the cost of dress for the year 2008 and 2009. It is also directed to pay Rs.1000/- as compensation and Rs.500/- as costs. Comply the order within one month from the date of receipt of copy of order.
