Heard counsel for  the petitioner.  In this case, the petitioner had collected examination fees and issued hall ticket and on last moment did not permit the respondent/complainant to appear in the examination on the ground that the complainant was short of attendance. The District Forum had directed the University to allow the complainant to appear in IV Semester examination of Criminology and Forensic Science course in the ensuing examination without collecting examination fees if she desires and also to pay a sum of Rs.500/- as cost.  This order was challenged by the petitioner before the State Commission.  The State Commission found that on merits, the stand taken by the University is that the original attendance register had not been produced in order to prove that the complainant was short of attendance.  Counsel for the petitioner states that he has no instructions as to whether complainant had already appeared for the examination.  He further states that no stay was granted by the State Commission of the order of the District Forum.  The order passed by fora below is just, fair and equitable.  In the facts and circumstances, the University should not have come in revision against the order of the two fora below.  In view of this, revision is accordingly dismissed, with no order as to cost.
