A perusal of the previous order dated 09.05.2023 has transpired that it was directed that the appeal shall be heard ex-parte against respondent.
After passing of the aforesaid order, the respondent has appeared before this Commission on 03.05.2024 and submitted an application dated 03.05.2024 (Paper No. 103), stating therein that a compromise has taken place between the parties outside the court. It was, therefore, requested that the appeal may be disposed of accordingly and the consumer complaint be dismissed.
The said application moved on behalf of respondent, has been kept on record.
It appears that a compromise has been arrived at between the parties outside the court, hence in such circumstances, in the light of submissions made in the application dated 03.05.2024 moved on behalf of respondent, the consumer complaint No. 350 of 2019 filed by the respondent before the District Commission, Haridwar, stands dismissed. Accordingly, the appeal is allowed. Impugned judgment and order 04.02.2021 passed by the District Commission is set aside. The parties shall bear their own costs.
The amount deposited by the appellant with this Commission, be released in its favour.
File be consigned to the record room along with copy of this order.
A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.
