Final Order / Judgement

Record is placed before the National Lok Adalat as per order dated 18.04.2024 for settlement of the matter.

Both the parties are present. Heard both the sides as to settlement of the matter. Considered.

It appears from the complaint petition that the complainants have filed the instant compliant against the OPs for deficiency in service and the complainant prays for passing an order directing the OPs-1 to 3 to refund a sum of Rs.19,92,352/- to the complainant along with interest @ 18% p.a. from the due date till its realization also compensation to Rs.5,00,000/- and litigation cost of Rs.60,000/-.

It is submitted for the OPs that the OPs are ready to settle the matter at Rs.16,92,352/- and the complainants are agreed with the proposal of the OPs.

In view of the above, the OPs are directed to pay a sum of Rs.1,00,000/- to the complainant within 15 days from the date of passing of this order and the rest amount of Rs.15,92,352/- to be paid to the complainants in 7 monthly equal installments of Rs.2,27,479/- each. The OPs are directed to pay the settled amount to the complainants through Demand Draft.  The OPs are also directed to submit the documents to show that the OPs have paid Rs.3,00,000/- to the Central Bank of India i.e. Financer within 15 days from the date of passing of this order.

In view of the above, it appears to us that the matter has been settled.

Hence, the CDF Unit-II, CC No. 239/2022 is settled and disposed of finally through the National Lok Adalat.

If the OPs transgress to comply the order of the Lok Adalat within the stipulated period the complainant are at liberty file appropriate application for execution as per law.

Let a copy of this order be supplied to both the parties free of cost with proper endorsement.
