This RA has been filed seeking amendment of a typographical error in paragraph 16 (ii) of the order dated 13.06.2023, where the date till which no maintenance charges or holding charges are directed to be levied is indicated as “26.03.2023” instead of “26.03.2015”. 2. In view of the fact that the Occupation Certificate and No Objection Certificate from the Town and Country Planning Department and Fire Service Department were obtained by the opposite party on 26.03.2015, any such charges for the period before this date is stated to be inadmissible as possession was only a paper possession. 3. The contention in the RA has been considered. It is evident that the date indicated in paragraph 16 (ii) of the impugned order, i.e., 26.03.2023 is a typographical error since the order is explicit in holding that no holding charges or maintenance charges be charged till the date on which the offer of possession made could be considered as legal. 4. In view of the foregoing, it is evident that there is an error apparent on the face of the record, therefore, the date indicated in paragraph 16 (ii) of the impugned order is amended to read as 26.03.2015 instead of 26.03.2023. 5. The RA no. 279 of 2024 stand disposed of with the above directions. |
