Miss Sayantani Ghosh, Ld. Advocate appears for OP 5, OP 6 and OP 7 by filing W/V.
Copy of W/V is given to the Ld. Advocate of the complainant.
OP 3 and OP 8 received notice on 27.10.2022 and failed to file W/V within the statutory period and therefore the case as against OP 3, OP 4 and OP 8 will proceed ex-parte.
The track report filed for OP 1 and OP 2 appear to be insufficient to highlight the service of notice upon them. Ld. Advocate appearing for the complainant prays for permission to cause service of notice upon OP 1 and OP 2 by way of paper publication.
He files an application to that effect.
After hearing the Ld. Advocate and adverting to the material on record we see that sufficient attempts have already been made for effecting service of notices upon them in the ordinary way. But those attempts have gone in vain. We are entitled to a view that service of notice upon them cannot be effected in the ordinary means and therefore the prayer made by the Ld. Advocate of the complainant appears to be well founded one and is allowed.
He is permitted to cause service of notice upon OP 1 and OP 2 by making publication of notice for them in either Ananda Bazar or Bartaman Newspaper fixing 07.02.2023 for their appearance and to file copy of newspaper containing such publication by the next date.
07.02.2023 is fixed for filing copy of newspaper.
The application is registered as MA/249/2022.
The application is thus disposed off.
