This complaint is filed by the consumer against Reliance Communications Ltd. for deficiency in service under section 12 of The Consumer Protection Act, 1986. The brief facts of the complaint are as follows,
1] The complainant is a resident of Sinhagad Road, Pune and the opponent has its branch office at Vadgaon Sheri. The complainant had obtained netconnect internet dongle no. 9326651596 from the opponent in the month of August 2012. It did not work. Hence, the executive took the dongle from him on the next day for repair. After 8-10 days the dongle was returned to him, but it was not working properly. The opponent assured to refund the deposit, which was made by the complainant i.e. Rs. 3000/-. Subsequently, the dongle was taken back and transferred to third person, still the opponent issued bill to the complainant. The complainant has filed this complaint for refund of Rs. 3000/-, compensation of Rs. 2,00,000/- for mental agony and cheating. He has also claimed an amount of Rs. 15,000/- for incidental costs.
2] The opponent though duly served remained absent. Hence the complaint proceeded ex-parte against her.
3] The complainant has produced voluminous documents along with list including correspondence and affidavit. It reveals from the correspondence that, the complainant has informed the opponent about selling the dongle by them to third party and the opponent is harassing him by making calls and threats. These facts are not denied by the opponents. In such circumstances, the forum is of the opinion that the opponent has caused deficiency in service. It reveals from the correspondence that, the complaint made by the complainant to the opponent is registered but not resolved. Hence, this Forum is of the opinion that the complainant should be compensated adequately for deficiency in service. The complainant is entitled for refund of Rs. 3,000/-, compensation of Rs. 5,000/- for mental and physical harassment as well as cost of Rs. 2,000/-. Hence, we pass the following order.
** ORDER **
1. Complaint is partly allowed.
2. The opponent is directed to pay total
amount of Rs. 10,000/- (Rs. Ten Thousand
only) to the complainant within 6 weeks
from the date of receipt of copy of this order.
3. Copies of this order be furnished to
the parties free of cost.
4. Parties are directed to collect the sets,
which were provided for Members within
one month from the date of order, otherwise
those will be destroyed.
