Complainant absent. Representing counsel filed an application seeking adjournment stating that counsel is laid up. Opposite parties absent, represented. Proceedings reveal that on 05/03/2021, 28/07/2021, 09/11/2021, 19/11/2021 and 15/12/2021 case was posted for complainant's evidence. There were specific directions for appearance of complainant on 09/11/2021, 15/12/2021 and 13/01/2022. Yet he has not appeared. Present application by counsel that he is laid up owing to fever and therefore case has to be adjourned for evidence does not give any reason for non appearance of complainant. Hence we are not inclined to grant any further adjournment for evidence. This case is of the year 2018. It is evident from the proceedings that the complainant is adopting dilatory tactics, to protract the proceedings. Presence and evidence by complainant is necessary for proceeding further. As he is shying away from giving evidence, this commission is unable to proceed further with this complaint. Hence complaint is dismissed for default, albeit without costs.
