NIKHIL & ORS. VS VARDHMAN ESTATE.

 

Present : Nikhil & Parul, complainant in person.

                     Adv. Swati Dey, counsel for OP.

 

            Both parties moved joint application wherein they state that matter has been amicably settled for an amount of Rs. 26,23,000/- subject to adjustment of Rs.7,00,000/-. It is further directed that in case the said amount is already received by the complainant in the form of assured return. Then OP can adjust the matter. OP is directed to file Proof with regard to the payment of Rs. 7,00,000/- to the complainant. In case OP failed to prove, then he is liable to make a further payment of Rs. 7,00,000/- then the said payment should be paid along with interest @ 9% through DD from the date of last installment made by the complainant to the OP. It is strictly directed that payment of decreetal amount will be madein three equal installment starting from 15.10.2022, 15.11.2022, 15.12.2022 respectively from the date of receipt of order either through NEFT or DD. It is further directed that the DD for each installment shall be made in two equal parts in the name of Nikhil and Parul respectively on 15.10.2022, 15.11.2022, 15.12.2022.

 

The matter is now listed for compliance of order on 08.12.2022. OP is directed to make the payment of remaining amount within 30 days from receipt of the copy of order. The settlement being fair and appropriate has been accepted.  Complaint is disposed of as settled.   Copy of   this order be given Dasti.
