     Mr.Nikhil Mehta, Advocate a/w Mr.Tushar Bundale, the office of the Appellant Insurance Company are present.  None for the Respondent.

     None present for the Respondent.  It is urged on behalf of the Appellant that the matter is settled between the parties out of Commission.  The statement is made at Bar that the amount of `1,33,011/- has already been paid to the Respondent.  Advocate Mr.Mehta has requested that the permission may be granted to the Respondent to withdraw the amount of `25,000/- which is lying with the Commission.  He also prayed that he wants to withdraw the appeal and hence, he may be permitted to withdraw the appeal in view of the application as per pursis filed by the Appellant.  Hence, the order:

Permission is granted to the Appellant to withdraw the appeal in view of the settlement between the parties. 

The Respondent is permitted to withdraw an amount of `25,000/- which is lying with this Commission.

Parties to bear their own costs.
