The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986. The facts as alleged in the complaint are that the complainant booked Valeentine Banquet Hall, 4 Shivaji Marg Najafgarh, New Delhi- 110015 for the wedding of his daughter on 21.12.2016 and paid Rs. 50,000/- advance through cheque No. 200456 drawn on United Bank of India , however, due to unavoidable circumstances ( i.e. death of grand mother of the groom) the complainant
get the booking cancelled on 24.01.2017 and demanded refund of the amount which was refused by OP. Therefore, the complainant filed present complaint.
We have perused the receipt dated 21.12.2016 by which banquet of OP was booked by complainant for wedding of his daughter scheduled for 19.02.2017. The complainant got the aforesaid booking cancelled on account on unfortunate incident of death of grand mother of the groom and demanded back booking of the Rs.50,000/- . The aforesaid receipt dated 21.12.2016 contains terms and conditions. Condition no. 3 provides “that advance/earnest money deposit shall not be refundable under any circumstance.” The Complainant was very much aware of this condition at the time of booking the banquet hall . The aforesaid term is incorporated on the receipt itself. We fail to understand as of what deficiency in service has been caused by OP rather OP has not provided any service due to cancellation of booking it is now the well settled law that terms and conditions of a contract between the individuals should be given on a plain meaning and that courts should not deviate from its natural meaning nor any addition or subtraction should be made to such terms and conditions.
Keeping in view the discussion stated above we do not find any deficiency on the part of OP, therefore, complaint being devoid of any merit is dismissed.
Copy of this order be sent to the parties as per rules.
File be consigned to the record room.
