                   Opposite party No. 1 already exparte.

                   Sh. Kunal Juneja, Advocate for opposite party No. 2.

                   Ld. counsel for the opposite party No. 2 made a statement that the settlement has been effected with the complainant for a sum of Rs.48,000/- and according to the settlement, OP is ready to give Rs.48,000/-  within 45 days to the complainant with the condition to return the old handset to the OP. The mobile in question could not be liquefied and damaged.

                       On the other hand, complainant has made a statement that he agrees with the above statement and has no objection to decide the case accordingly.

                   In view of the statements made above, present complaint is hereby disposed of being compromised with direction to the OPs to pay the alleged amount of Rs.48,000/-(Rupees forty eight thousand only) to the complainant within 45 days and complainant shall return the handset in question to the OPs. Parties shall be bound by their respective statements. Copy of this order be supplied to the parties free of cost.

                    File be consigned to the record room after due compliance.
