                     Pulak Kumar Singha :– Complainant files this case u/s.12 of the C.P.Act. In brief the case of the complainant is that complainant purchased one vehicle, Model No.ZEST XE 1.3QJET bearing Chassis No.MAT624002HPC10182 and Engine No.100A2000-0676254 on 26.04.2017 from O.P. by making payment of Rs.6,40,000/-

including Registration fees Rs.4,300/-, said amount was paid through financial assistance of Indusind Bank. On 07.6.17 complainant paid further Rs.60,000/- to O.P. for detaining National Permit. O.P. was given one Smart Registration Card being No.OD34E1220 containing with above mentioned Chassis No. and Engine No., thereafter complainant knocked the door of O.P. for obtaining National Permit but O.P.did not pay heed. Complainant on query came to learn that such vehicle Registration No.OD-34E/1220 was not issued in favour of his vehicle ZEST XE 1.3QJET. Complainant sent legal notice to solve the problem but O.P. did not give any reply, for which complainant has been suffering mental pain and also financial loss. Complainant approached before this Forum for getting redressal as per prayer of his complaint.

         Inspite of duly service of summon upon the O.P. none appeared and also not contesting the case on behalf of O.P., as such the case is heard ex-parte against O.P.

 

                                                                                   Decision with Reasons.

         We carefully readover the complaint, evidence and documents filed by the complainant. Fact of the case is that complainant purchased one car Model No.ZEST XE 1.3 QJET from O.P. by an exchange offer with his Indica Vista Car bearing No.WB-30P/9645, by making payment of Rs.6,40,000/- including Registration fee of Rs.4,300/-. The said vehicle was purchased by financial assistance of Indasind Bank on 26.9.2017. Subsequently complainant on 07.6.2017 paid Rs.60,000/- for obtaining National Permit from M.V. Department of Odisha. O.P. delivered one Smart Registration Card No.OD/34E/1220 containing Chassis and Engine No. of newly purchased car of complainant. Complainant on various occasion knocked the door of O.P. for taking delivery of National Permit but O.P. did not pay heed. Then a doubt created in the mind of complainant and after enquiry complainant came to learn that such Smart Registration Card bearing No.OD-34E/1220 is not issued in favour of his vehicle as well as in his name as owner, rather said number is issued against another vehicle of another owner. Complainant met with the O.P. and asked why O.P. supplied fake Registration Certificate but O.P. did not give any reply rather kept silence themselves. For such act of O.P. the vehicle in question is unable to ply on road without registration which is kept in idle condition in the garage of complainant, but complainant is compelled to pay the monthly installment to the financer Indasind Bank. From  the documents R.C. status, it appears that Registration No.OD-34E-1220 ,Date of Registration-09.11.2017 bearing Chassis No.MAIXE2GRKH2J and Engine No.GRHRJ of Maxicab(L) vehicle is issued in favour

of one Prasanta Kumar Das. Complainant adduced evidence in his favour and submitted

(9) documents which are marked exibit. O.P. did not contest the case as such the evidence of complainant is unchallenged and uncontroverted. Complainant made prayer of his

complaint to direct the O.P. to return back the vehicle in question and refund Rs.6,40,000/- along with Rs.60,000/- with interest and compensation with litigation cost. But at the time of argument Ld. Lawyer of complainant submits that due to non-payment of regular installments financer has repossessed the vehicle in question. At present complainant prays for refund Rs.60,000/- and compensation with litigation cost from O.P. 

 

         In view of the above discussions we find that O.P. has made unfair trade practice and deficient in service for which complainant has suffered mental pain and financial loss, as such complainant is entitled to get an order to refund Rs.60,000/- with compensation and litigation cost.

 

         The complaint case succeeds.  

                                                                                                                          

                               Hence, it is,

                                                Ordered

                         that the Complaint Case be and the same is allowed ex-parte against O.P. with cost.

O.P.is directed to refund back Rs.60,000/- with 9% interest from 07.6.17, to pay Rs.25,000/- as compensation for unfair trade practice and deficiency of service and to pay Rs.2,000/- as litigation cost to the complainant within one month from the date of order.

Failure to comply this order O.P. shall be liable to pay Rs.2,000/- as penal cost to the Consumer State Welfare Fund till full realization.                                    

Let a  plain copy of this order be supplied to the parties free of cost.
