Heard. Vide impugned order the appeal filed by the petitioner before the State Commission was dismissed in default due to non appearance of petitioner as well its counsel. It would be pertinent to point out that petitioner who was opposite party before the District Forum did not appear and was proceeded ex parte. Keeping in view the facts and circumstances of the case, impugned order passed by the State Commission is set aside, subject to payment of Rs.40,000/- as cost. Cost be deposited by way of demand draft in the in the name of onsumer Welfare Fundas per Rule 10A of the Consumer Protection Rule, 1987, within four weeks from today. In case petitioner fails to deposit the cost within the specified period, the present petition shall stand dismissed, without any further order. Accordingly, revision petition is disposed of. State Commission shall decide the matter in accordance with law after hearing both parties. Petitioner shall appear before the State Commission on 15.4.2013. Dasti.
