ORDER

Though on the last date of hearing, the respondent/complainant had appeared in person, but today he is absent despite the fact that the case has been called out for hearing the second time.  Accordingly, we have heard learned counsel for the petitioner/opposite party.

Having regard to the fact that it was the first date of hearing for which notice had been issued to the petitioner, we are of the view that the State Commission should not have proceeded ex parte against the Petitioner.  Therefore, in order to avoid further delay in disposal of the complaint and, in the interests of justice, we set aside the impugned order subject to the petitioner paying to the respondent a further sum of Rs.10,000/-, for causing unnecessary harassment to him.

The petitioners are directed to file their written version within four weeks from today.

The case be listed before the State Commission on 5.11.2014 for further proceedings.

Revision Petition stands disposed of accordingly.
