Muniyappa, By-Kottur, Byraganapalli Post, Srinivaspur Taluk, Kolar District. .Complainant V/S V. Srinivas (K.S.R.T.C) Karthik Cable T.V. Gownipalli Village & Post, 563 161 Srinivaspur Taluk, Kolar District. .Opposite Party ORDERS This is a complaint filed under section 12 of the Consumer Protection Act, 1986 praying for a direction against the opposite party to pay Rs.6,000/- with compensation, interest and costs etc., 2. The material facts of complainants case may be stated as follows: That the complainant was one of the members of lottery scheme sponsored by OP and his membership no. was 59 and he paid Rs.400/- per month for a continuous period of 15 months i.e. from 15.06.1999 15.08.2000 and thereafter the said scheme was abruptly stopped by OP in the middle and he did not return the amount to the subscribers. It is alleged that the complainant went on demanding the repayment of subscription amount but the OP went on postponing the payment on one or other ground and finally the complainant issued notice dated 09.09.2009 for which the OP did not reply. 3. The OP refused to receive the notice sent by this Forum under RPAD. The service of notice on the OP is taken as sufficient. He has not filed any version, even on the adjourned date. The complainant filed affidavit and produced the relevant document in support of the averments made in complaint. 4. We perused the allegations made in the complaint and perused the records. We are satisfied regarding the truth of the allegations made in the complaint. The subscription amount paid by complainant may be ordered to be returned with interest at 10% p.a. Hence we pass the following: O R D E R The complaint is allowed with costs of Rs.1,000/-. The OP shall pay Rs.6,000/- (rupees six thousand only) to complainant with interest at the rate of 10% p.a. from 15.08.2000 till the date of realization within 1 month from the date of this order.
