Oral order :  

 

                                               This appeal is directed against the impugned order dated 15.4.2006 passed by District Forum, Nellore   

 

According to the complainant he opened SB Account with OP 1 Bank.   

 

  

                                               OP 3 in its version has admitted Nellore     

 

During the enquiry,

 

Basing on the evidence the District Forum has adjudicated the points on deficiency in service,. Jurisdiction of the Forum, the Limitation aspect and also the entitlement of the relief’s claimed for. The evidence adduced by the parties was discussed and in its conclusion arrived at the finding that the OP 1 bank has admitted that the cheque sent to OP 1 was misplaced and a fresh cheque was obtained from

We have gone through the entire pleadings and as well the evidence on record    Nellore    

 

The District Forum in its discussion has placed reliance upon the decision of the Hon’ble Supreme Court reported in Union Bank of India Vs. Viswamohan AIR 1998 SC 2311 and also the decision of AP High Court in   

 

During the hearing of the appeal, the appellants     

 

We feel that the decisions relied on by the District Forum are not applicable to the facts of the case on hand.    Nellore
