Complainant and opposite parties absent. No representation or application since 10/12/21 onwards. Complaint is filed alleging deficiency of service against OP1 to OP3. Complainant had booked air tickets from online booking agency of OP1 in flights operated by OP2 and OP3. Flight was cancelled and money paid for flight tickets was not refunded. As per complaint and ticket details (Document No.1) an amount of Rs.20,322/- is claimed with interest from opposite parties. However it is stated in the complaint that Rs.14,436/- has been refunded by OP2 to OP1. Hence OP2 cannot be made liable to answer the claim of complainant. OP1 and OP3 have not appeared despite receipt of notice. Therefore it is to be taken that complaint averments are not challenged/assailed by them. Therefore these are taken as proved as against them.

Hence complaint is dismissed against OP2 and allowed against OP1 and OP3 as hereunder:-

 

1. OP1 and OP3 are directed to pay Rs.20,322/- to complainant jointly and severally with interest @ 15% per annum from 14/04/2020 till date of payment/ realisation.

2. OP1 and OP3 shall pay the account within 45 days from the date of receipts of this order.

3. Complainant has not prayed for costs. Hence we make no order as to costs.
