We have heard the learned counsel for the parties and have gone through the case file very carefully.

2.            Vide order dated 16/11/2012 the direction was given to the OPs to shift the tubewell connection of the complainant subject to condition that as per rules and regulations of the Nigam any amount is to be deposited by the complainant, the complainant shall deposit the same and the OPs shall shift the tubewell connection of the complainant.

3.            Sh. Ashwani Kaushik, SDO concerned has filed his affidavit dated 09/09/2016 in compliance of order of this Forum dated 16/11/2012 during the execution proceedings further stating that demand notice dated 25/06/2014 and 17/07/2014 have been sent to the Decree Holder to deposit the estimated amount, but the Decree Holder has filed to deposit the required amount. When the Decree Holder is not depositing the estimated amount with the JDs, the JDs cannot be said to be at fault and as such no action is required to be taken by this Forum. Therefore, the present execution petition is hereby dismissed. The parties concerned be communicated to the order accordingly and the file consigned to the record room after due compliance.
