Heard counsel for the petitioner.  The respondent had imposed penalty of Rs.48,779/- on the petitioner on the ground that the complainant had committed theft of energy in unauthorized manner.  The District Forum had allowed the complaint and quashed the said penalty.  However, in appeal filed by the respondent/opposite party, the State Commission has very rightly held that the petitioner cannot be considered as consumer in case of theft of electricity.  The conclusion of the State Commission, in our opinion is well founded, just and equitable and does not call for interference in the exercise of revision jurisdictional.  The revision is, accordingly dismissed, with no order as to cost.
