Heard counsel for the petitioner at length. At this stage our attention is invited to the observation made by the State Commission: ndisputedly, the electricity connection bearing A/c no. G- 3/1748 was installed in the Aara Machine of the complainant wherein the electricity was use for commercial purpose. Thus, as per the provisions of Section 2 (1) (d) of the Act, 1986, the complainant does not fall within the definition of onsumer The Honle National Commission in case cited as Mohammad Haseed Ahmad vs Maharashtra State Electricity Board and Ors 2010 CTJ 886 (CP) (NCDRC) wherein a consumer had obtained electric connection for stone crusher, held him not to be a onsumer Learned counsel for the petitioner submits that he wants to withdraw this revision petition with liberty be granted to him to approach the Civil Court. In view of the statement made by the learned counsel for the petitioner the revision petition is dismissed as withdrawn. Liberty is granted to the petitioner to approach the Civil Court.
