Heard learned counsel for the petitioner. Complainant filed complaint before District Forum with a prayer to quash demand raised by the opposite party/respondent. Opposite party resisted complaint and submitted that bill was raised on the basis of checking report dated 12-05-2011 according to which the meter body and seals of the meter were found tampered with. Learned District Forum after hearing both the parties allowed complaint. Appeal filed by the opposite party was allowed by learned State Commission vide impugned order, against which this revision petition has been filed. Honle Apex Court in U.P. Power Corporation Ltd. & Ors. vs. Anis Ahmad, held that cases pertaining to theft of electricity are not to be considered by Consumer Fora. in such circumstances, as complaint was not maintainable before District Forum, revision is liable to be dismissed. Consequently, revision petition filed by the petitioner is dismissed at admission stage with liberty to the petitioner to approach appropriate authority under the Indian Electricity Act for Redressal of his grievance. He is at liberty to take all the objections before appropriate authority.
