ORDER

Heard the learned counsel for the parties.

Learned counsel for the petitioner states, under instructions, that the petitioner is ready to submit to the jurisdiction of the Arbitrator who had to be appointed pursuant to the direction of the relevant Civil Court quite some years ago.  He adds that despite the complainant/petitioner having applied formally to the respondent Nigam, appropriate action to appoint the Arbitrator has yet to be taken by the latter.  Learned counsel for the Nigam, on the other hand, accepts that the Nigam would take expeditious steps to appoint the Arbitrator so that the arbitration proceedings can be completed without further loss of time.

 

 

In view of the foregoing, the respondent is directed to appoint the Arbitrator under the relevant provisions of the Electricity Supply Act within two weeks from today.  The Arbitrator so named shall also take all possible steps to pass his award within three months thereof.  If dissatisfied with the award, parties shall be at liberty to pursue their remedies in accordance with law.

Both the revision petitions are disposed of in the foregoing terms.
