ORDER

1.       This revision petition has been filed under Section 21(b) of the Act 1986 in challenge to the Order dated 15.10.2015 of the State Commission in appeal no. 57 of 2003 arising out of the Order dated 29.12.2001 of the District Commission in complaint no. 273 of 1995.

2.       Learned counsel for the petitioner complainant submits on instructions that the complainant wishes to withdraw his revision petition. Authorized representative of the complainant (his brother) present in person confirms.    

3.       The instant revision petition no. no. 319 of 2016 is dismissed as withdrawn, without the option to file it again before this Commission.

4.       Learned counsel for the respondent housing & development authority submits that the housing & development authority has not agitated the Order dated 15.10.2015 of the State Commission and as such it will comply with the direction contained therein i.e. to refund an amount of Rs.2800/- to the complainant with interest at the rate of 6% p.a. Learned counsel also submits that the said payment will be made within four weeks from today.

5.       It may also be added here that this Commission has not examined the case on merit.

6.       The Registry is requested to send a copy each of this Order to the parties in the petition and to their learned counsel within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
