ORDER:                    

 

                Complaint presented today. It be checked and registered.

 

                The fact of the complaint is that present complaint has been filed by the complainant u/s 12 of the Consumer Protection Act 1986 on the averments that an electric connection, vide account no.2197 has already been installed at the residential house for domestic purpose in the name of the mother of the complainant i.e. Smt. Darshna Devi wife of Shri Tilak Raj. The complainant has been paying electricity charges to the office of OP regularly as per consumption. In the year 2017, the said electric meter had burnt due to sparking in the electric line and the complainant had informed the OPs three/four times. In this regard, the mother of complainant had also submitted an application dated 16.01.2017 before the office of the OP at Assandh. Accordingly, on 24.01.2017 the officials of the OP inspected the house of the complainant and the electric meter found burnt. Even the complainant had also deposited an amount of Rs.10,258/- in the office of OP as demanded by the officials, vide receipt dated 25.01.2017. Thereafter, in the month of June, 2017 the officials of the OP replaced the electric meter of the premises and thereafter the complainant started paying the electricity bills as per consumption.

2.             Thereafter, in the month of February, 2020 the official of the OP had sent an electricity bill for a total amount of Rs.1,08,538/- and the complainant shocked to see the excess amount Rs.1,06,913/-. Infact, the complainant has not at all consumed the units as alleged in the bill amounting to Rs.1,08,538/-. However, it is not believable that in a domestic connection the alleged units of the huge amount consumed at a small house. Moreover, no outstanding was pending against the complainant in respect of the aforesaid electric connection. The official of the OP told the complainant that as per reading of the electric meter, the complainant will have to pay the alleged amount of Rs.1,08,538/-, which is totally incorrect as the units as alleged in the said bill have not been consumed by the complainant. The complainant requested the official of the OP several times to correct the amount of electricity bill but the officials of the OP postponed the matter on one pretext or the other but now the officials of the OP flatly refused to correct the aforesaid electricity bill and are adamant to recover the alleged amount of Rs.1,08,538/- from the complainant illegally and forcibly. In this way there was deficiency in service on the part of the OP. Hence complainant filed the present complaint.

3.             A careful perusal of the file would reveals that it is a theft case and in the theft cases, this Forum has no jurisdiction to entertain and try the complaint. Hence, the present complaint is hereby dismissed at the stage of admission. The party concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
