None has appeared on behalf of the appellant whereas learned counsel Smt. Shashi Yogeshwar for respondent has appeared.

Hence, put up after some time for arguments.

Case is again called out. 

Appellant alongwith his counsel has not appeared inspite of several calls, whereas learned counsel Smt. Shashi Yogeshwar for respondent has appeared.

Since a long time appellant is not appearing and contesting the case; it appears that the appellant is not interested to continue the appeal. 

In such circumstanes, the appeal is hereby dismissed. No order as to costs of the appeal.

File be consigned to the record room alongwith copy of this order.

A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.
