Heard Smt. Anjali Gusain, learned counsel for the applicant and perused the record.
This miscellaneous application has been filed by the applicant for releasing the amount of Rs. 25,000/-, which was deposited by the applicant towards mandatory deposit while filing First Appeal No. 613 of 2004; Life Insurance Corporation of India Vs. Smt. Usha Pant.
The aforesaid appeal was filed by the applicant before this Commission against the judgment and order dated 25.11.2004 passed by the District Commission, Nainital in consumer complaint No. 124 of 2002; Smt. Usha Pant Vs. Life Insurance Corporation of India.
This Commission vide order dated 03.05.2006 has partly allowed the aforesaid appeal.
Against the judgment and order dated 03.05.2006 passed by this Commission, the applicant has filed Revision Petition No. 2195 of 2006; Life Insurance Corporation of India Vs. Smt. Usha Pant, before Hon’ble National Commission, which has been disposed of by Hon’ble National Commission vide judgment and order dated 22.04.2015.
According to office report dated 11.03.2024 / 28.03.2024, in furtherance of judgment and order dated 25.11.2004 passed by the District Commission, the applicant has paid the entire decretal amount to the opposite party.
In view of above, the miscellaneous application is allowed. The aforesaid amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) deposited by the applicant with this Commission, be released in favour of the applicant.
File be consigned to the record room along with copy of this order.
