            The facts of the complaint in brief are as follows:

            That the complainant filed this complaint on the ground that opposite party committed deficiency in their service by delaying the supply of refilled LPG cylinder inordinately.  According to the complainant after booking he has to wait months to get the filled cylinder.  The complainant therefore prays for an order directing opposite party to supply the refilled gas cylinders regularly as per the provision or circular and direction to pay compensation of Rs.10,000/-.

2.         Opposite party duly served notice, not turned up.  Name of opposite party called absent, set exparte.

3.         Complainant filed proof affidavit and Exts. A1 and A2 marked. Heard the complainant.

4.         Ext.A1 is the Domestic Gas Customer card and Ext.A2 print out of the message from the mobile phone of complainant.

5.         The case of the complainant is that the opposite party failed to supply the refilled  gas within reasonable time and thereby the complainant suffered much.

6.         In order 9 of the Liquefied  Petroleum Gas (Regulation of Supply and Distribution) order 2000 deals with the procurement, storage and sale of Liquefied Petroleum Gas by a distributor.  As per S.9(c) of the said order the distributor is bound to maintain sufficient stock at the business premises at all times.  Therefore it was the bounden duty of the opposite party to keep the stock at the business premises at  all time and to regularize  the supply of refilled cylinders so as to enable consumer to get his refilled gas cylinder at least within 10 days from the date of booking.  There is no contra evidence before the Forum.  Delay in supply amounts to deficiency in service.

            Therefore the complaint is allowed and opposite party is directed to supply refilled gas cylinders to the complainant within 10 days from the date of booking and further directed to pay compensation of Rs.3000/- and cost of Rs.2000/- to the complainant.

            Time for compliance is 30 days from the date of  receipt of copy of order.
