Present: Sh. Arjun Harkauli, Counsel for the Appellant Along with Sh. R.S. Chadda, AR of the Appellant.
Sh. Upender Gupta, Respondent-1 in person.
The parties have entered into a compromise without prejudice to their rights and contentions.
Appellant has agreed to pay a sum of Rs. 71,000/- + 20,000/- interest on it in full and final settlement of the present case qua the respondent-1.
Since motor cycle is stated to be on superadari, same is not being directed to be returned to the appellant.
It is stated that the aforesaid amount shall be given to the respondent-1 by way of demand draft within 4 weeks.
Since the matter is amicably settled, the deposit towards State Consumer Welfare Fund as ordered by the Ld. District Forum is reduced to Rs. 1,00,000/-.
On filing the receipt of having deposited the amount with State Consumer Welfare Fund, the FDR lying in this Commission be returned in favour of the appellant along with interest.
Appeal stands disposed of accordingly.
File be consigned to record room.
