Appeal is directed against an Order passed by the Consumer Forum, Ernakulam dismissing the application of petitioners/ appellants who were some among the opposite parties in a consumer complaint, for setting aside the exparte Order passed against them in the complaint. That application was moved with a petition for condoning delay of 537 days . When the application was posted for enquiry petitioners remained absent. The forum below was also not satisfied with the reason stated for condoning delay and hence their petition was dismissed. Challenge is against that Order.
We heard counsel for petitioners/ appellants. We notice that the appellants are public enterprise and its officers. Normally, entertaining an appeal challenging an Order dismissing an application for setting aside exparte Order will only delay the proceedings further. We find that after dismissing their application for setting aside the exparte order the forum below has disposed the complaint passing an Order exparte. The appellants have to prefer an appeal against the exparte Order disposing the complaint with petition for condoning delay showing sufficient cause thereof, if they are really aggrieved by the exparte Order passed.
Without prejudice to the right of petitioners/appellants to file an appeal against the exparte Order disposing the complaint , with petition for condonation of delay we dismiss the application filed to condone delay in preferring the present appeal. Appeal is also rejected .
