JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT
 
            Appellant is the complainant in CC.180/06 in the file of CDRF, Kollam. The complaint stands    dismissed for default. It is submitted that the counsel for the complainant that there was omission to note the correct   posting date and hence the matter could not be pursued.
          2.We find that the opposite party had entered appearance in the matter of 2006.
          3. In the circumstances, and in view of the fact, that the complainant had sought for a substantial amount of compensation, and the matter required consideration the order of the Forum is set aside on condition that the appellant deposit 500/- to the Legal Aid Fund of this Commission within 10 days.
          4. On deposit of the amount, the order of the Forum will stand set aside. The Forum is directed to re-consider the entire matter and permit the parties to adduce evidence and dispose of the case on merits.
          5. The matter will stand posted to 11.8.09 before the Forum. The Forum will issue notice to the opposite parties. 
          The office is directed to dispatch the copy of this order to the Forum urgently.
