                                             ORDER IN THE QUESTION OF MAINTAINABILITY

  1. At the time of admitting the complaint, it was felt necessary to hear the question of maintainability as pleadings were insufficient to prove that the O.P.1 was a dealer as contemplated under the Act.
  2.  Complainant purchased a pre-used car from OP1 on 11/05/2020.  Subsequent to purchase, the O.P.1 failed to transfer the name of the owner(complainant) of the vehicle in the official records. This complaint is filed seeking a direction to the O.P.s 1 and 2 to effect change in the records by entering the name of the complainant as the owner of the car.  
  3. A perusal of the pleadings would not show that the 1st O.P. is  a seller in the course of business and hence the 1st O.P. is not a product seller as contemplated under S.2(37) of the Act. Therefore, this complaint is not maintainable as against the 1st O.P.
  4. 2nd O.P. is a statutory body carrying out official function without availing consideration as contemplated under the Act. Any payments effected to the 2nd O.P. will be fees, fines or tax prescribed by the Statues or Rules.
  5. Accordingly, we dismiss the complaint as not maintainable.
