JUDGEMENT
In pursuance of the order passed by this forum on 09/11/2010 complaint is posted today to enable Op to deliver new hand set and pay damages.The representative of the Ops submit that an order may be passed to that effect and submits that today he is prepared to pay Rs.4,000/- as damages as ordered.Counsel for the complainant submits that there will be variation in the cost of the mobile set that may be ordered to be adjusted.If there is variation in the cost of the mobile set that shall be taken care of at the time of complying the order, as it is subject to the variation of the cost of mobile set and liability of J.Dr.Cash of Rs.4,000/- paid today.The counsel for the complainant reports receipt of the same.Both parties submit for passing the order for exchange of mobile set.With this, we pass the following order.
O R D E R
Complaint is allowed in part.Ops 1 to 3 are jointly and severally held as deficient in their service and therefore are directed to replace the mobile with a new once of the same brand and of the same cost.If there is variation in the cost of the mobile set that shall be adjusted by refunding and thisq order shall be complied within 15 days from today.
Op shall deliver the set with seal intact and if he failed to comply the order within the stipulated period he shall pay damages of Rs.100/- per every month of delay.
Both parties to bear their own cost.
Complainant shall return all accessories to the Ops.
