2. Harsh Mandhan minor son of deceased Vikas Mandhan, through complainant No.1 being the natural guardian and mother of minor complainant, resident of village Garhi Birbal, Tehsil and District Karnal.

1.     Univesal Sompo General Insurance Company Limited, through its General Manager, SCF 55, 3^rd Floor, Sector-6, Main Market, Karnal, Haryana, 132001.

2.     Universal Sompo General Assoterch One, C-20/1A/1, near Labour Chowk, Sector-62, Noida (UP).

3.     Shiv Shakti Industries, Makhu Majra Road, village Bara Gaon, Tehsil and District Karnal, through its owner Shri Shashank Garg.

Complaint under Section 35 of Consumer Protection Act, 2019.

               Today the case is fixed for issuance of notice to OP No.3, subject to filing correct address. Neither correct address has been filed by the complainant nor none has put in appearance on behalf of complainant.

                A careful perusal of the file reveals that the present complaint has been presented on 14.03.2023. OP No.1 was proceeded against exparte on 12.05.2023 and OP No.2 appeared through his counsel on 27.07.2023. Thereafter the case was repeatedly adjourned for issuance of notice to OP No.3, subject to filing of correct address but till today the case is going on the same proceedings as the complainant has failed to complete the formalities for getting the service of OP No.3 effected. The case pertains to the year 2023 and approximately 1 ½ years have been laposed but the complaint is still at initial stage. It appears that the complainant is not interested to pursue with the present complaint.

                Hence, in view the above facts, the present complaint is hereby dismissed. However, complainant is at liberty to file fresh complaint on the same cause of action, after impleading the parties with correct addresses, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
