File taken up today on filing of an application, by the learned counsel for the complainant, for pre-ponement and withdrawal of the case being compromised. Learned counsel for the OPs has suffered a statement, which is recorded separately, to the effect that matter has been compromised with the complainant whereby the OPs are ready to pay a sum of Rs.23.73 Lacs in full and final settlement to the entire claim of the complainant in the present case, subject to completion of formalities and submission of NOC form issued by the finance company. Payment will be made within 30 days from the receipt of copy of order. Learned counsel for the complainant has also suffered a statement, which is recorded separately, to the effect that he has heard the abovesaid statement of the learned counsel for the OPs and agrees with the same, as such, he withdraws the present complaint on behalf of the complainant.
In view of the aforesaid statement suffered by the learned counsel for the OPs and the learned counsel for the complainant, the present complaint is hereby dismissed as withdrawn being compromised. It is made clear that parties shall remain bound by their statements. Certified copy of this order passed in Lok Adalat be supplied to the parties concerned, free of costs, as per rules. File be indexed and consigned to record room, after due compliance.
